Local law 196 of 2017 made amends to the Administrative Code of the City of New York and the New York City Building Code, in relation to Construction Site Safety Training (SST). The law mandates that construction workers undergo safety training classes beginning March 1, 2018, with full training being required by as late as September 1, 2020. Updates:
The LL196/2017 Site Safety training will be done in three (3) phases:
Phase 1 ended on March 1, 2018, which required workers to complete OSHA-10; or OSHA-30; or a 100-hour training program approved by the DOB.
Phase 2 will end on December 1, 2018, and requires workers to complete OSHA-10 and additional 20-hours of DOB approved training, or the 100-hour training program approved by the DOB. Supervisors need to have completed OSHA-30 and a minimum of 30 additional hours of DOB approved training.
Phase 3 needs to be completed by May 1, 2019, and requires workers to complete OSHA-10 and additional 30-45 hours of DOB approved training or the DOB approved 100-hour training program.
Worker Logs
A log at the construction site that lists the workers and proof that they have completed the required training will be required from permit holders; the log should be produced upon request by an inspector on site.
Other SST Trainees
Individuals new to the construction industry need to complete an OSHA-10 training before they can be allowed to work. They then need to complete a 40-hour training within 6 months in order to continue working.
Concrete Safety Managers, Construction Superintendents, Site Safety Coordinators and Managers need to complete a minimum of 60 hours of training.
Construction workers at job sites with a Site Safety Plan and those sites with Superintendents, Site Safety Coordinators or Managers need to complete a minimum of 40 hours of training before Phase 3 completes in 2019.
Delivery persons, flag persons, Professional Engineers, Registered Architects, Special Inspectors, and Department-licensees (excluding safety professionals) do not require training. Workers that are involved with minor alterations or the construction of a new 1-, 2-, or 3-family home also do not require training.
Violations
Construction sites that fail to prove that their workers have been properly trained will result in a violation and civil penalty of up to $5,000.00 per worker.
A violation and civil penalty of $2,500.00 will be issued as well if the permit holder fails to update the log of workers that proves completion of training.
