Violations & Fines on the Increase for Lacking Construction Site Safety Training Requirements Under Local Law 196 of 2017
Construction Site Managers Beware! Word has it that the DOB is on the prowl for offenders of LL196 of 2017, issuing violations, fines and stop-work orders.
The DOB announcement dated February 2018 is as follows:
Local Law 196 of 2017: Construction Safety Training
Local Law 196 of 2017 requires workers and supervisors at certain construction sites receive safety training. The safety training requirements will be phased-in in three parts beginning on March 1, 2018, with full training being required no later than September 1, 2020.
1. Training
As of March 1, 2018, workers must receive, at a minimum, the following training:
- an OSHA 10-hour class; or
- an OSHA 30-hour class; or
- a 100-hour training program approved by the Department.
Training received before October 16, 2017, will be acceptable in any format. Training received after that date must be in-person or actively proctored online training (actively proctored online training confirms the individual’s identification before providing secure access to the online training and monitors participation during the course of training).

You will be required to certify on a soon to be updated PW2 that workers have been properly trained in order to obtain a permit.
2. Logs
Beginning March 1, 2018, permit holders will be required to maintain, and produce upon request, a log at the construction site that identifies each worker and includes proof that the worker completed the required site safety training.
