Stop Work Order Patrol Intensifies


Already in full swing in Brooklyn and Queens, the NYC DOB in partnership with the NYC Department of Finance deputy sheriffs are sweeping construction sites in Bronx and Staten Island to crack down on illegal construction activity. The Inspectors are conducting unannounced inspections of construction sites already having Stop Work Orders. The Stop Work Order Patrol is an important component of the NYC Department of Building’s new Special Enforcement Plan.

Stop Work Orders can be issued for a range of violating conditions, including:

  • Working without a permit
  • Working with expired permits
  • Working after hours without an after hours variance
  • Failing to provide approved plans on site
  • Working contrary to approved plans

Illegal construction activities are a threat to the safety of the general public, to those performing the work, and to the future occupants of the buildings. The Building Department is issuing violations with immediate and costly Civil Penalties which must be paid before the Stop Work Order can be lifted. The DOB’s goal is to dissuade illegal construction by making it too costly and time-consuming for those that ignore the law. The Civil Penalties range from $2,000 to $10,000 per violation. For contractors that continually disobey Stop Work Orders, the DOB may pursue criminal prosecutions.
