New Construction Superintendent Rule

In May 2007 Buildings Commissioner Patricia J. Lancaster, FAIA announced the Construction Superintendent Rule.

The Construction Superintendent Rule introduces a registration requirement for individuals overseeing demolition or new construction of buildings under 15 stories

For us at P. Wolfe, that means the New Building and Demolition Permit (PW-2) for buildings up to and including 14 stories will need to be signed by a registered Construction Superintendent. Only a Construction Superintendent will be allowed to sign the PW-2.

As of July 5, 2008 the requirement will apply to all one, two and three-family homes.

In addition to proving identification and qualification, Safety courses either SITE or OSHA will be required of each Construction Manager. Also, “…If designated the construction superintendent at these “low-rise” sites, an individual must be registered, be available to the Buildings Department at all times, engage in sound and code-compliant construction practices, and maintain a safe work site.”

Licensed Site Safety Managers – Not required to register as a Construction Superintendents.

Incumbents: Individuals actively serving on New Building, Alteration Type I or Demolition permits issued between January 1, 2007 and July 4, 2007 may continue in their position if they apply for registration with the DOB by December 31, 2007. Online registration: Use LIC-3 and LIC-4

Qualifications:

  • Licensed architect or engineer AND within the past three years completed a seven-hour SITE SAFETY MANAGER course or a 10-hour OSHA course, or;
  • Have been a Construction Superintendent for five of the past 10 years and within the past three years completed a seven-hour SITE SAFETY MANAGER course AND 10-hour OSHA course, or;
  • Have been a carpenter, mason or building inspector for five of the past 10 years and within the past three years completed a 40-hour SITE SAFETY MANAGER course AND a 10-hour OSHA course.

INCUMBENTS: DEADLINE APPROACHES!!!

December 31, 2007 is the deadline for those individuals who current serve as Construction Superintendent on active New Building, Alteration Type I or Demolition permits issued between January 1, 2007 and July 4, 2007. You will be required to attend a 10-hour OSHA course.
