ยง28-14.8.4 of the 2014 construction code provides for a "tenant protection plan." It states that for any alteration project done for buildings with occupied dwellings during construction will require a "TENANT PROTECTION PLAN."
This plan specifies and provide in sufficient detail data regarding particular dwelling locations/units that will be occupied during construction as well as the methods to be used to ensure the safety and health of such occupants. The plan can include temporary fire-rated assemblies, dust containment procedures.
The elements for such will vary depending on the scope and nature of work to be done but should have detailed provisions for the following:
1. EGRESS
Any construction for that matter needs to have a provision for a proper and adequate egress as required by this code and in particular the tenant protection plan should identify the egress to be provided.
2. FIRE SAFETY
All necessary controls and laws applicable to the construction including those for occupied dwellings and other safety measures as necessary for the construction shall be observed strictly.
3. HEALTH REQUIREMENTS
The plan shall detail the methods by which the construction will control dust and/or pests, dispose of construction debris, maintain sanitary facilities and control noise levels. Compliance (backed up by a statement of compliance) with applicable provisions for asbestos and lead shall also be included.
4. COMPLIANCE WITH HOUSING STANDARDS
The requirements as set by the NYC Housing Maintenance code and the New York State Multiple Dwelling Laws (where applicable) shall always be strictly implemented.
5. STRUCTURAL SAFETY
No structural work that may endanger the occupants shall be done.
6. NOISE RESTRICTION
Such limitations as to the hours of the day or days of the week in which construction will be done are limited in respect to the New York City noise control code shall be stated.
