In zoning, the term mixed-use buildings are used for buildings located within commercial districts that are partly used as residential dwellings and as commercial and even as community facilities as well.
Zoning Requirement
Zoning requirement vary depending on the zoning district but this generally governs the size of the lot, floor area covered, setbacks, density, heights, open space, yards, and even parking. Also, depending on your district, regulations for quality housing may also be in effect. Additional mixed-use building requirements may also be required for modifying the basic bulk regulation for each use as well as for the whole building itself.
Building Code Requirement
In the building code, the DOB implements site safety, fire protection and exits, structural standards, height and area limitations and accessibility. Building code requirement may also include mechanical, plumbing and fuel gas codes which all needs to be addressed when applying for a new mixed-use building.
Fire Code Requirement
Fire protection systems as well as mandatory access for firefighters and fire-fighting equipment are set forth in the fire code requirement and fire department approvals can be a requisite depending on the variables like building height, location and other circumstances.
Energy Code
The State and the city has an energy code wherein all buildings must be in compliance, including all new mixed-use buildings. Compliance with COMcheck for the minimum required thermal rating for the building envelope is a must as well as minimum efficiency ratings for the heating equipment is mandatory.
Do take note that this is simply an overview of the basics for erecting new mixed-use buildings, there maybe additional requirements depending on the applicable zoning resolutions, building and construction codes, energy code as well as the multiple dwelling law and other agency approvals.
